Abstract

Legal argumentation is a crucial element in the interpretation and application of law. This process allows legal positions to be substantiated through evidence and reasoning, facilitating judicial decision-making and the evolution of the legal system. Its role is especially relevant in judicial proceedings, where it allows lawyers and prosecutors to structure solid arguments to analyze facts, laws, and precedents, with the goal of persuading judges or juries. Argumentation in this context not only involves the presentation of evidence but also the rebuttal of the opposing party's arguments, demanding deep legal knowledge and critical analysis skills. Furthermore, it is essential for justifying judicial decisions and seeking a fair and just resolution to legal conflicts. This approach is based on logical reasoning, evidence, and sound legal interpretation. It also allows for the advancement of law by promoting the analysis of other fields and areas of law.
